Facts: Laura Ann Sails-Ehsan, female age 38, went to Defendant for the extraction of tooth #14.  While attempting to remove the tooth Defendant broke Laura Ann's jaw.  Because Laura Ann is now deceased, of unrelated causes, this suit was brought by her estate.  Survival action was brought on her behalf and loss of consortium was brought on behalf of her husband, Nadeem Ehsan.  Plaintiff claimed too much force was used while pulling the tooth.  Defendant claimed that the tooth was ankylosed (fused to the bone) and that he did not use excessive force in attempting to remove the tooth.

Damages Alleged: Broken jaw (broken bones 14 and 15 attached to the upper left tooth); and 2 cm. tear in the palate from the mouth into the nasal cavity) ($6,011.08 medical expenses).

Demand before trial: $125,000 according to Plainitff's attorney, $200,000 according to Defendant's attorney.
Offer before trial: $10,000.
Verdict: For Defendant.
